Terms of Service

By commissioning/purchasing from me you must agree to the terms and conditions below, please make sure you review them prior to buying

TOS is subject to change at anytime

GENERAL

Take time to fill out commission forms properly. Its extremely irritating to me when people do not follow instructions, especially since I try to make it easy to understand. Forms must be filled out completley before commission is accepted

I do not provide guaranteed time frames, unless asked for by the commissioner. If the commissioner wants a specified due date I need to be notified at least 1 month in advance.

Note: As of 11/2022 wait times have increased for all commission types, up to potenially 2 months.

Deluxe commissions can take much longer than a standard option and time frames vary greatly.

Please be aware that the wait times may be long but dont hesiate to reach out to me for an update.

No order reservations

I will provide a progress shot of the sketch stage and flat color for all commission types besides YCH. If you would like progress shots of YCH you must let me know. Please do not pester me for excessive progress shots (more than once a week) I do not like to be rushed and it may result in a cancellation and partial refund.

I will provide minor edits to your finished image if I have forgotten something, I do not do any major edits after the image has been posted

I reserve all rights to my artwork

My art is my IP unless otherwise agreed upon with commissioner

I am allowed to reproduce, distribute, and use as self promotion in anyway

Note: I do not use artwork with commissioned characters for commercial purposes without permission from commissioner, nor do I

claim any characters/species as my own

You cannot reproduce, use, and/or alter my work in any form for commercial purposes, unless you specifically request to use it as so when ordering.

*Commercial commissions will incur a price % increase*

You can produce prints/stickers/ect of your commission for personal, non profit use

You can reupload artwork to other websites but MUST credit me as the original creator

Commissioners who recieve PSD files are not allowed to reproduce, alter, and/or use any aspect of the original file for profit or personal use and/or claim as their own creation.

PAYMENT

Payments are accepted in USD only.

Original invoice must be paid in full before I start work on your piece.

Due dates are added to invoices, make sure you pay before or on your due date. Failure to pay by your due date will result in a cancellation.

If you request a payment plan

You are required to pay at least 50% downpayment and the other 50% later

Note: keep in mind commissions will not be

started until i have the full 100% payment

Client acknowledges that invoice totals are not final until final artwork has been delivered, and additional charges can be sent after the original invoice has been paid. Customer reserves the right to deny any additional charges, but work related to the charges will not be completed.

example: if you have a design commission and its 100$ and you paid the invoice, and while we are working you want to add a bunch of super complicated edits. In this case, you agree that I can send additional charges if the artwork becomes much more complicated than initially agreed upon.

However, if you do not want to be charged any extra you have all rights to say no, but I have all rights to not complete the work related to said extra charges.

CANCELLATIONS AND REFUNDS

See PAYMENT section about related cancellations

I reserve the right to cancel and fully/partially refund your commission at any time.

The customer may request a full refund if the artwork has not been started yet, please contact me for your status.

Refunds are not available on works that are at, or beyond the lineart stage

Partial refunds are available in the sketch stage, amount is deducted from time spent working

Chargeback claims

Filing a chargeback claim will result in a violation of my TOS and your rights to the artwork will be revoked completely. The artwork will also be taken down and repurposed.

Designs that have an open chargback claim will have ownership terminated and transfered back to me where the design will be resold.

You will be placed on my banned list with reason for banning,

and are prohibited from commissioning me or purchasing adopts

I will dispute any chargebacks

ADOPTABLES/ CUSTOM DESIGNS

Limited species:

Dragon adopts

Designs

All other design commissions/adopts that do not have a specific TOS

You do not need to notify me of owner transfer

You are allowed to edit the design freeley. Change species, change markings, ect.. The sky's the limit

Species changes for the dragons is prohibited, and their base designs should be recognizable

If the design is on a closed species base, you cannot claim the species as your own or create additional characters on your own

I do not offer refunds on adoptables, however I do allow reselling. If you decide to open a chargeback claim see CANCELLATIONS AND REFUNDS section.

When reselling the design the design owner has full control on resale value.

Violation of these terms and conditions can result in legal action if necessary.
